Fulton County District Attorney Fani Willis has a lot to answer for thanks to a bombshell court filing.
Willis’s indictment against Donald Trump is on the verge of complete collapse.
And now Fani Willis may have broken the law in this ugly sex scandal.
Political consultant Michael Roman’s attorney, Ashleigh Merchant, set off a political and legal earthquake in a court filing seeking to dismiss the charges against Roman on the grounds that Willis illegally appointed special prosecutor Nathan Wade and also violated conflict of interest rules in Georgia due to Willis and Wade carrying on a romantic affair.
“It alleges that Willis and Wade have been involved in a romantic relationship that began before Wade was appointed special prosecutor. It says they traveled together to Napa Valley and Florida, and they cruised the Caribbean using tickets Wade purchased from Norwegian and Royal Caribbean cruise lines — although the filing did not include documentation of those purchases,” the Atlanta Journal-Constitution exclusively reports.
Willis paid Wade $654,000 over two years even though Wade had no experience prosecuting any RICO cases.
Wade also allegedly used the money Willis’s office paid him to take Willis on a vacation to Napa Valley and to book a cruise, charges which if proven true could turn into criminal charges for violating federal honest services fraud statutes.
“The district attorney chose to appoint her romantic partner, who at all times relevant to this prosecution has been a married man. Admittedly, this is a bold allegation considering it is directed to one of the most powerful people in the State of Georgia, the Fulton County District Attorney. Nevertheless, the district attorney’s fame and power do not change the fact that she decided to appoint as the special prosecutor a person with whom she had a personal relationship and who is now leading the day-to-day prosecution of this case. Even assuming this type of nepotism might be forgiven in the abstract, a review of the amount of money that the special prosecutor has been paid by the district attorney and the personal activities of the district attorney and the special prosecutor during the pendency of this prosecution shed light on just how self-serving this arrangement has been,” the filing read.
Merchant also argued that Willis improperly appointed Wade as special prosecutor without the approval of the Fulton Board of Commissioners as per Georgia law.
Since Wade helped obtain the indictment against Trump despite an invalid appointment and running afoul of conflict of interest regulations, Merchant argued Judge Scott McAfee should throw out “the criminal indictment in its entirety against Mr. Roman on the grounds that the entire prosecution is invalid and unconstitutional because the Fulton County district attorney never had legal authority to appoint the special prosecutor, who assisted in obtaining both grand jury indictments. As a result, both indictments contain structural errors and irreparable defects and should be dismissed in their entirety as to Mr. Roman.”
From the outset, legal experts like George Washington Law Professor Jonathan Turley poked holes in Willis’s case as it wasn’t really grounded in the law.
But now Willis may not even get to test her allegations in court in front of a jury due to the questionable nature of her alleged personal conduct.
