When Donald Trump nominated Brett Kavanaugh to the Supreme Court conservatives thought they finally achieved a decades-long goal of moving the court to the right.
Tucker Carlson got some bad news about Brett Kavanaugh that you won’t like.
The Supreme Court heard oral arguments on cases involving two of Joe Biden’s tyrannical federal vaccine mandates.
Justices now must decide the fate of Biden’s scheme to require businesses with more than 100 employees to force vaccination and for medical facilities that receive Medicare and Medicaid dollars to mandate vaccines for their workers.
Constitutional lawyer Harmeet Dhillon appeared on Tucker Carlson’s show and offered a mixed bag of predictions as to how the cases would shake out.
Dhillon told Carlson that based on her reading of the oral arguments the court’s conservative majority stood ready to strike down Joe Biden’s totalitarian private sector vaccine mandate.
However, Dhillon predicted that the justices would leave the health care worker mandate in place because that involved federal funding.
“I think there may be a split ruling out of the court. I think on the case…challenging the large employer mandate, it looks to me like we have five or six votes to enjoin that order,” Dhillon explained. “But on the one regarding medical facilities, because the order is tied to federal funding, I think there are some different arguments there and the justices seem more likely to uphold that OSHA mandate on medical facilities.”
To keep Biden’s mandate in place, conservative justices like Brett Kavanaugh would have to bend and allow the vaccine requirement to proceed.
Dhillon also criticized the court for sitting on a decision and injecting massive uncertainty into the American economy.
That’s because justices did not deliver a ruling on the day the mandate took effect leaving businesses that employ 80 million workers twisting in the wind with no idea on how to proceed in implementing Biden’s mandate.
“Today is day one when the compliance is supposed to be occurring and that’s true for 80 million employees around the country,” Dhillon added,”so the fact the court is still sitting on this and hasn’t ruled yet produces tremendous expense, uncertainty, stress and disruption to the American economy. I really hope for the sake of all those employees, employers that the court rules quickly so that we can move on and arrange our affairs accordingly.”
Dhillon also predicted that if the court struck down the private sector employer mandate “there will be many states, probably New York, California and other states, that decide it’s within their power to order this type of thing and we will have a fresh round of litigation over it.”
The federal government never before imposed a national vaccine mandate.
Donald Trump and his supporters counted on Brett Kavanaugh and the other judges Trump appointed to the bench to stop illegal schemes like Biden’s federal vaccine mandate.
And conservatives will be left disappointed once again if the justices do not rule their way.
