And the Supreme Court slammed Kamala Harris with a defeat that left Democrats shaken.
Since Joe Biden named Kamala Harris as his administration’s border czar the illegal immigration crisis spiraled out of control.
The number of illegal aliens marching across the southern border increased reaching a peak in July when the Border Patrol intercepted 212,000 illegal aliens pouring into the country.
Now Harris, as the point person for the administration’s open borders policies, suffered another defeat when the Supreme Court’s six Republican appointees dealt Harris and Joe Biden a massive defeat by rejecting a request to stay a lower court ruling ordering the administration to implement the Migrant Protection Protocols – or what is known as “Remain in Mexico” – while the case works its way through the court system.
“The application for a stay presented to Justice Alito and by him referred to the Court is denied,” the court’s conservative justices wrote.
The majority argued the administration stood little chance of winning on the merits and that Joe Biden likely broke the law when rescinding the Migrant Protection Protocols.
“The applicants have failed to show a likelihood of success on the claim that the memorandum rescinding the Migrant Protection Protocols was not arbitrary and capricious. Our order denying the Government’s request for a stay of the District Court injunction should not be read as affecting the construction of that injunction by the Court of Appeals,” the Supreme Court’s ruling read.
Back in August, Texas Federal District Court Judge Matthew J. Kacsmaryk ruled the administration violated the Administrative Procedure Act by not taking into account the cost illegal aliens imposed on states in terms of healthcare and school spending as well as issuing drivers’ licenses.
Judge Kacsmaryk wrote the Migrant Protection Protocols “deterred migrants from attempting to illegally cross the border, allowed the Department of Homeland Security to avoid systemic violation of federal immigration law’s detention requirements, and reduced the burden on states caused by tens of thousands of aliens being released,” Yahoo reported.
The Migrant Protection Protocols kept an estimated 70,000 illegal aliens waiting in Mexico for their asylum claims – 86 percent of which end up being denied – to play out in immigration courts.
By trying to get rid of the Migrant Protection Protocols the Biden administration sought to reimpose “catch and release” – the process by which the government turns illegal aliens loose into the country after apprehending them and providing the illegal aliens a court date.
Rolling back this policy symbolized the commitment to open borders the Biden administration brought into office.
And now Kamala Harris as border czar just received a massive rebuke from the Supreme Court.
