The corporate media is about to be on the wrong end of some bad news.
This legal battle could change America forever.
And Sarah Palin is about to start one court case that could end The New York Times.
In 2017, The New York Times published an op-ed after a Bernie Sanders supporter attempted to assassinate 20 Republican members of Congress while they practiced for a baseball game.
The assassin wounded House Majority Whip Steve Scalise and nearly killed Scalise.
In the op-ed, the Times tried to “both sides” political violence by publishing the lie that the man who shot Arizona Democrat Congressman Gabby Giffords back in 2011 was linked to a map on the website for Sarah Palin’s PAC which placed targets on the districts of Democrats Palin’s PAC raised money to defeat in the next election.
In the op-ed,the Times falsely claimed the shooter was inspired by Palin’s website and also falsely claimed that the website featured crosshairs over the faces of Democrat members of Congress when in reality the website placed the crosshairs over their districts.
The following day the Times issued a correction that read:
An editorial on Thursday about the shooting of Representative Steve Scalise incorrectly stated that a link existed between political rhetoric and the 2011 shooting of Representative Gabby Giffords. In fact, no such link was established. The editorial also incorrectly described a map distributed by a political action committee before that shooting. It depicted electoral districts, not individual Democratic lawmakers, beneath stylized cross hairs.
Under The New York Times v. Sullivan Supreme Court precedent, public figures like Sarah Palin face an extremely high bar to prove a news outlet defamed them.
The court ruled that a public figure must prove that a news outlet published a defamatory story knowing the story was false.
Yet two weeks after the Times published their op-ed featuring false claims Palin sued the Times for defamation.
After nearly five years of legal wrangling Palin will finally have her day in court.
The corporate media is terrified of this case.
In this matter, the Times published a false story about an event that happened six years ago where it was well publicized that the shooter had no connection to Palin and was not inspired by the map on her website.
A normal fact-checking protocol should have caught these errors.
Palin argued the only reason these falsehoods made it into the Times piece was because the paper desired smearing her.
Supreme Court Justices Neil Gorsuch and Clarence Thomas expressed a willingness to re-examine the Sullivan precedent.
Sarah Palin’s lawsuit possesses the potential to redefine First Amendment case law in America.
And that is a major threat to The New York Times.
