Joe Biden and his administration may have just bit off more than they can chew.
This fight could go all the way.
And now Joe Biden will end up at the Supreme Court after picking a fight with one Republican.
Last month U.S. District Judge Steven Merryday ruled in favor of Florida Governor Ron DeSantis in striking down Centers for Disease Control guidelines requiring cruise ship lines to show proof that 98 percent of the crew and 95 percent of the passengers were vaccinated among other restrictions in order to take paying customers once again.
Governor DeSantis signed legislation banning vaccine passports, and subsequently sued the administration claiming the cruise line should not need to wait for CDC guidelines to resume operations.
Judge Merryday ruled in Florida’s favor blasting the CDC for ignoring state law as well as the harm imposed on the cruise ship industry.
“Never has CDC conditioned pratique as extensively and burdensomely as the conditional sailing order; and never has CDC imposed restrictions that have summarily dismissed the effectiveness of state regulation and halted for an extended time an entire multi-billion-dollar industry nationwide,” Judge Merryday ruled.
“In a word, never has CDC implemented measures as extensive, disabling, and exclusive as those under review in this action,” the judge’s order continued.
However, a three-judge panel voted 2 to 1 to lift Judge Merryday’s order and allow the Centers for Disease Control vaccine mandate to take effect.
DeSantis reacted by vowing to fight on by either appealing to the full 11th Circuit Court or to the Supreme Court.
“We are absolutely going to pursue to get the stay removed, either at the full 11th Circuit or at the U.S. Supreme Court,” DeSantis stated.
DeSantis expressed optimism that the state’s appeal would succeed.
“I’m confident that we’d win on the merits, at the full 11th Circuit and, honestly, I’m confident we’d win at the US Supreme Court.” DeSantis added.
There is a bit of 2024 politics at play here.
Biden and his allies are looking for ways to slow down Governor DeSantis’ momentum heading into 2024.
DeSantis built a following in the GOP by largely rejecting lockdowns and never imposing a mask mandate.
Governor DeSantis became a national star by following the science and data – and ignoring Dr. Fauci’s fear mongering – by keeping Florida’s economy and schools open while blue states like California and New York locked down and suffered the consequences.
Polls show DeSantis is the frontrunner for the 2024 GOP nomination if Donald Trump doesn’t run, and Democrats are worried that the popular governor of a key swing state could prove to be an unstoppable force in 2024.
