Joe Biden is in deep trouble.
Biden’s shaky presidency absorbed another blow.
And that’s because Joe Biden set up a Supreme Court showdown that this close ally admitted is bad news.
In response to slipping poll numbers, a furious Joe Biden sought to rally his base of neurotic liberals that think even though they took three vaccine shots and wear two masks, unvaccinated Americans could breathe death on them at any moment.
During a bizarre speech to the nation where Biden told vaccinated Americans that unvaccinated Americans were their enemies, Biden announced a totalitarian scheme to impose a federal vaccine mandate on 80 million Americans.
Under Biden’s authoritarian scheme, companies with more than 100 employees must mandate vaccination for all workers or face fines of $14,000 a day.
It was an unprecedented power grab that legal experts immediately denounced as unconstitutional.
Even Biden’s normal allies at CNN called into question the legality of the federal vaccine mandate.
Legal analyst Jeffrey Toobin – who CNN somehow still puts on the air even though Toobin’s coworkers at The New Yorker saw Toobin masturbating while on a Zoom call – told viewers Biden’s mandate rested on shaky legal ground.
Toobin did note that it was not quite a national mandate as it only applied to employers with more than 100 workers.
“It’s close, but it is not everyone in the United States,” replied Toobin. “I think the technical legal term for what went on today is ‘No more Mister Nice Guy.’”
But Toobin added that “this is the beginning of getting closer to a national mandate.”
Toobin said it was up for debate if the vaccine mandate passed legal muster as the justification for the vaccine mandate was the same as the eviction moratorium that the Supreme Court already struck down.
“There is the question, though, of whether the federal government has the legal authority to do this. OSHA [Occupational Safety and Health Administration] supervises employee safety,” Toobinadded. “Whether that authority extends to requiring vaccines for people in companies bigger than 100 employees, you can be sure this is going to be challenged in court. I don’t know the answer to that, but I do know that this is certainly a shot across the bow by the Justice Department and by the White House, saying, ‘Look, we are sick of asking. We are now telling you to get [vaccinated].’”
The executive branch cannot use federal agencies to implement policies that can only be enacted by Congress.
And like the eviction moratorium Biden knows he is imposing an unconstitutional policy to appease his angry base knowing full well the Supreme Court will strike it down.
