Back in 1986, President Joe Biden described court-packing as “a bonehead idea” and said that former President Franklin Delano Roosevelt made a “terrible, terrible mistake” when he unsuccessfully tried to add six justices to the Supreme Court in 1937.
Biden added that “it put in question, if for an entire decade, the independence of the most significant body … in this country, the Supreme Court of the United States of America.”
If presidents add justices to the Court whenever they want then the Supreme Court becomes nothing more than an extension of the executive branch.
What Biden is doing isn’t normal partisan politics. He’s shaking the foundations of American government in order to pass a radical agenda that most Americans don’t agree with.
Radical socialist Sen. Bernie Sanders (I-VT) warned that if Democrats pack the courts then “the next time the Republicans are in power they will do the same thing.”
Yet House and Senate Democrats are reportedly preparing legislation that would add four new justices just weeks after Biden announced that he had created a commission to study court-packing.
“The bill would add four seats to the high court, bringing the total to 13, from the current 9,” The Intercept reported. “The bill is led by House Judiciary Committee Chair Jerry Nadler, Subcommittee chair Hank Johnson, and freshman Rep. Mondaire Jones. In the Senate, the bill is being championed by Ed Markey of Massachusetts.”
During the presidential campaign, Biden said that voters didn’t “deserve” to know whether he’d pack the Court or not.
“You’ll know my opinion on court-packing when the election is over,” Biden told reporters before the election. “Now look, I know it’s a great question and I don’t blame you for asking, but you know the moment I answer that question, the headline in every one of your papers will be about that other than focusing on what’s happening now.”
Mike Davis, founder and president of the Article III Project (A3P), warned that Biden’s move was “alarming” and must “be met with the harshest of denunciations from both sides of the aisle” because packing the Supreme Court would lead to “irreversible damage.”
“Packing the Supreme Court would destroy centuries of hard work from Democrat- and Republican-appointed justices to insulate the high court from partisan politics,” Davis warned. “It also raises serious red flags as to what unconstitutional actions President Biden is planning that a more favorable Supreme Court might tolerate.”
