When Donald Trump nominated Brett Kavanaugh to replace Anthony Kennedy, conservatives expected a new conservative majority that would flex its legal muscles.
The Supreme Court just heard oral arguments in cases over Joe Biden’s authoritarian COVID vaccine mandates for companies with more than 100 workers and healthcare facilities that receive Medicare and Medicaid taxpayer dollars.
The initial media accounts of the oral arguments reported that the six Republican-appointed justices peppered the Biden administration lawyers with hostile and skeptical questions.
Many Americans believed the issue before the court was simple as the federal government owned no constitutional authority to impose a national vaccine mandate.
But Pennsylvania Democrat Congressman Matt Cartwright predicted in an interview on “Fox News Live” that the Supreme Court would “find a middle ground” and uphold Biden’s vaccine mandate for workers in health care facilities that receive Medicare and Medicaid funding.
“It’s a heavily conservative court right now, as you know, and all of them are double vaccinated and boosted. And so, that’s an interesting dynamic,” Cartwright told Fox News. “You know, what they are doing is they’re questioning, well, is it administrative overreach, and maybe they will decide that.
“It seemed likely that they are going to try to find some kind of middle ground, Mike, you know, where only companies that get money from Medicare and Medicaid, or maybe health care operations, can be subject to an OSHA mandate like that. I do expect them to reach some kind of middle ground like that, but the bottom line is go out and get vaccinated. It’s not political. Donald Trump is double vaccinated. If you care about making your family safe and your friends and your loved ones, go out and get vaccinated,” Cartwright declared.
Such a decision would require one of Trump’s picks – and Brett Kavanaugh would be the likely suspect – to cave to the left and allow Biden’s tyrannical vaccine mandate to take effect.
The federal government never before mandated the general population take a vaccine.
With the explosion of the Omicron variant, the surge in cases – especially among those that received two doses of the vaccine and a booster shot – obliterated the rationale for the vaccine requirement.
Since the vaccine does not prevent transmission of the virus there is no justification for a federal vaccine mandate.
But if Congressman Cartwright is correct, the Republican-appointed Supreme Court justices may be on the verge of rescuing some part of Joe Biden’s federal vaccine mandate.
