Donald Trump and many conservatives believe the 2020 election was unfair.
Democrats will not be able to count on one of their favorite tricks from that election in the next go-round.
And Democrats lost this massive court case that is bad news for 2024.
Joe Biden carried Wisconsin by 20,000 votes.
But Wisconsin was one of the states where Trump and his supporters pointed out there were irregularities.
Racine County Sheriff Christopher Schmaling accused election officials of ignoring state law and permitting illegal ballot harvesting in nursing homes across the country.
The state also used ballot drop boxes under the cover of making it safer to vote due to COVID.
All of this funny business fueled a sense among Republicans that Democrats illegally gamed the system to flood the state with mail-in votes to put Joe Biden over the top.
But heading in 2022 and 2024 conservatives scored a major victory when the state Supreme Court ruled ballot drop boxes violated state law.
Wisconsin Institute for Law & Liberty filed a lawsuit on behalf of two men arguing that the use of ballot drop boxes “causes doubts about the fairness of the elections and erodes voter confidence in the electoral process,” and that their clients “are entitled to have the elections in which they participate administered properly under the law.”
Wisconsin state law reads that ballots must “be mailed by the elector, or delivered in person, to the municipal clerk issuing the ballot or ballots.”
This plain reading of state law shows that ballots being returned “in person” means what it says.
A four-justice majority wrote that “ballot drop boxes are illegal under Wisconsin statutes.”
The majority added that it is illegal to “receive a ballot from or give a ballot to a person other than the election official in charge.”
Justice Brian Hagedorn – the swing justice on the case – delivered the crucial fourth vote and wrote that it wasn’t the justices’ job to rewrite state law, and that if voters didn’t like the law that was what elections and the political process was for.
“Some citizens will cheer this result; others will lament,” he wrote of the majority decision. “But the people of Wisconsin must remember that judicial decision-making and politics are different under our constitutional order. Our obligation is to follow the law, which may mean the policy result is undesirable or unpopular. Even so, we must follow the law anyway,” Justice Hagedorn wrote.
A case out of Arizona showed the dangers of ballot harvesting schemes.
Prosecutors sought a one-year prison term for Democrat school board member Guillermina Fuentes who participated in an illegal ballot harvesting effort during the 2020 election.
The Washington Times reports:
Prosecutors are seeking a one-year prison sentence for a school board member in southern Arizona for illegally collecting four early ballots during the 2020 primary election…
…Authorities say Fuentes and Juarez participated in “ballot harvesting.” That’s a practice once used by both political parties to boost turnout but was made illegal by a 2016 state law that barred anyone but a family member or caregiver from returning early ballots for another person. It’s the only case filed so far by the state attorney general under the law, which the U.S. Supreme Court upheld last year.
Authorities say Fuentes, a former San Luis mayor, ran a sophisticated operation using her status in Democratic politics in the Arizona border city to persuade voters to let her gather and, in some cases, fill out their ballots. But the crime she admitted in court last month does not involve filling out ballots or any broader efforts.
Contrary to the corporate media’s false claims that the 2020 election was the most safe and secure in American history the contest was closer to the wild, wild west with Democrat officials and judges illegally changing state laws to facilitate the Democrat Party’s mail-in voting and ballot harvesting operations.
The decision by the Wisconsin State Supreme Court will add sanity and confidence in the state’s electoral process by making sure the election administrators follow the law.
