Someone just found out it is a terrible idea to get on Clarence Thomas’ bad side.
That’s not a good place to be.
And all hell broke loose when Clarence Thomas obliterated this Supreme Court justice.
At a conference in Texas, Clarence Thomas called out Chief Justice John Roberts for fostering an environment of mistrust behind the scenes with the justices.
Speaking of the court before 2005 – the year the Senate confirmed Chief Justice Roberts – Thomas said “we actually trusted each other. We may have been a dysfunctional family, but we were a family, and we loved it.”
Thomas’ comments come in the wake of someone – likely a liberal law clerk – leaking Justice Samuel Alito’s draft opinion striking down Roe v. Wade.
Chief Justice Roberts is reportedly scheming behind the scenes to flip either Brett Kavanaugh or Amy Comey Barrett to adopt Roberts’ position of surrender in leaving Roe v. Wade in place.
Roberts has a history of behind-the-scenes wheeling and dealing to appease the left.
Back in 2012 Roberts recruited liberal Justices Stephen Breyer and Elena Kagan to a “compromise” on Obamacare that saw Breyer and Kagan vote to strike down the law’s Medicaid expansion in exchange for Roberts flipping his vote and ruling that Obamacare’s individual mandate passed constitutional muster.
CNN reported:
Roberts posited in a draft opinion that Congress had in effect held “a gun to the head” of the states by conditioning all Medicaid money on the expanded coverage. Yet he was not prepared to find that the expansion had to be scrapped altogether, only that states could not be forced to join through the leverage of losing all Medicaid funding.
Breyer and Kagan had voted in the private March conference to uphold the new Medicaid requirement, and their votes had been unequivocal. But they were pragmatists. If there was a chance that Roberts would cast the critical vote to uphold the central plank of Obamacare – and negotiations in May were such that they still considered that a shaky proposition – they were willing to meet him partway.
Justices Thomas and Alito have grown visibly annoyed with Roberts’ judicial timidity.
This last term Roberts again crafted another compromise that allowed a 1990 precedent allowing the government to discriminate against religious liberty to stand.
Three years ago, Roberts voted with the left to strike down a Trump administration initiative to stop counting illegal aliens in the census – which have blocked blue states from winning new congressional districts in the census – to stop Donald Trump from ending Barack Obama’s unconstitutional amnesty for the children of illegal aliens, and to grant special rights to transgenders.
Roberts is always in fear of angering the left and the wins for the right tend to be the perfect case Roberts can handpick to craft the narrowest ruling possible to win a “victory” that is just so.
And now Justice Thomas took his complaints with Roberts’ cowardice and sneaky behavior public.
