And liberals in Congress just launched their latest salvo in this battle.
And now Donald Trump has one decision to make about Brett Kavanaugh that will change everything.
House Judiciary Committee Chairman Jerry Nadler isn’t just trying to impeach President Trump.
Nadler is also running a secret impeachment operation against Justice Kavanaugh.
Nadler dispatched a letter to the National Archives requesting documents about Kavanaugh’s time working in the Bush administration.
The Judiciary Committee Chairman claimed Democrats were working on legislation creating a code of conduct for justices and needed to study the policy issues Kavanaugh worked on during his time in the administration to see if they conflicted with issues the Supreme Court would rule on.
Democrats know there are no conflicts of interest that cause Kavanaugh to improperly decide a case.
What they want to see is if there are any inconsistencies in Kavanaugh’s Senate confirmation hearings so they can claim he perjured himself and introduce articles of impeachment.
Democrats are still bitter about Donald Trump winning the 2016 election and nominating Neil Gorsuch and Brett Kavanaugh to the Supreme Court.
Their confirmations allowed conservatives to achieve a generations long dream and hold a five to four majority on the highest court in the land.
But Democrats are putting their own long-term plan into motion.
And it involves two steps.
First, the Democrats want to harass Kavanaugh with document requests trying to conjure up a perjury charge so they can impeach him or force his resignation.
The second part involves defeating Donald Trump in 2020 so his Democrat successor can nominate a left-wing ideologue and swing the court to a five to four liberal majority.
If that ever happens the liberals on the court will be sure to take up cases to overturn the Citizens United and Heller decisions which solidified the right to free speech and to keep and bear arms.
Political experts also predict a liberal Supreme Court majority would strike down state pro-life and right to work laws.
But Donald Trump can throw a monkey wrench into these plans.
Current law allows for the current and former Presidents to scrutinize document requests sent to the National Archives to determine if any of the records are protected by executive privilege.
That means George W. Bush and President Trump will get to pour over the request and make it known if any documents are privileged.
Not only will this delay the National Archives producing any records, but it could also kill the Democrats’ stealth impeachment inquiry.
Conservatives turned out in droves in 2016 to make sure Donald Trump – and not Hillary Clinton – was the one filling the seat belonging to the late justice Antonin Scalia.
But if conservatives thought the Democrats would accept defeat and move on they were sorely mistaken.
