Donald Trump is about to be in for the fight of his life.
Last fall, the Senate confirmed Brett Kavanaugh to the Supreme Court and conservatives thought they had finally shifted the court to the right for good.
But now, the last Supreme Court Justice anyone ever expected may retire—and it will cause all hell to break loose in Washington.
Justice Clarence Thomas is a hero in the conservative movement.
Thomas has served on the court since 1991—after surviving a smear campaign during his confirmation hearing where radical leftists tried to use Anita Hill’s decade-old allegations of sexual harassment to derail his nomination.
Since then, Thomas has established the most consistent conservative voting record of any judge in American history.
Now he is 70 years old.
If Donald Trump wins re-election, Thomas will be in his mid-80s during Trump’s successor’s second term.
Should that be a Democrat, conservatives would be faced with the panic liberals now confront with Justice Ruth Bader Ginsberg.
Some liberals wanted Ginsberg to retire back in 2013 after Obama won re-election and the Democrats had control of the Senate.
That would have allowed Obama to install a younger leftist, putting three of the liberal bloc’s four Supreme Court seats safely out of reach for 30 to 40 years.
And there has been some speculation floating around Washington that Thomas may retire this summer.
That would allow Trump and the Republicans to tee up a confirmation fight heading into the 2020 election.
And the New Yorker’s Jeffrey Toobin – who serves as their legal correspondent – believes this may be the case.
Toobin explained what would happen if Thomas retired: “The President would likely nominate as a replacement Amy Coney Barrett, a forty-seven-year-old judge on the Seventh Circuit. A former professor at Notre Dame Law School, Barrett was nominated to the appeals court by Trump, in 2017, and she has already been considered for a Supreme Court seat—the one that went to Kavanaugh. Her politics appear even more conservative than Kavanaugh’s or Gorsuch’s; she has been open in her disdain for the concept of abortion rights for women. She is a devout Catholic and has, in the past, expressed a willingness to overturn precedent, which some observers think makes her even more certain than Kavanaugh and Gorsuch to vote to overturn Roe v. Wade.”
Conservatives fought for two generations to establish a majority on the court.
They saw that goal come within their grasp when Brett Kavanaugh replaced Justice Anthony Kennedy.
Thomas is the oldest conservative Justice on the court.
If Trump replaced him with a conservative firebrand in their 40s, there would be little chance the Democrats could swing the court back to the left, even if a Democrat President serves in both 2024 and 2028.
And such a move would be permanent.
However, even though liberal Justices Stephen Breyer and Ginsberg are in their 80s, they’re likely hanging on so a Democrat President can replace them.
If a Democrat replaces them with young leftists—and also gets a crack at Thomas’ seat—that would cement a radical left-wing majority on the court for generations.
So will Washington see another Supreme Court retirement this summer?
