Many of the biggest fights of the Trump administration have taken place in the nation’s court system.
But one court case stood out above all the rest.
And the Supreme Court delivered this victory that had Trump breathing a sigh of relief.
This July, the Trump administration announced new asylum rules that would ban illegal aliens from entering the country and requesting asylum unless they had first done so in a country the passed through on the way to America.
The common sense thinking behind the new rule was that if these illegal aliens were truly trying to escape persecution they would not travel over 1,000 miles to request asylum and instead would do so at the earliest opportunity.
Open borders activists immediately sued and Obama District Court judge Jon Tigar in San Francisco slapped a nationwide injunction on the rules blocking them from going into place.
Throughout the Trump administration’s nearly three years in office, Obama District Court judges ordered 40 nationwide injunctions blocking Trump policies.
In the eight years of Barack Obama’s Presidency, courts imposed just 20 nationwide injunctions.
Under Attorney General William Barr’s leadership the Trump administration took a more aggressive approach in combating Obama District Court judges using their local perch to set national policy.
Conservatives on the Supreme Court agreed and put the rogue Obama judges in their place.
The Supreme Court issued a brief ruling lifting Tigar’s nationwide injunction and allowing the administration’s new asylum rules to go into effect.
Left-wing justice Sonia Sotomayor issued a dissent – which was joined by Ruth Bader Ginsburg – whining that the administration took the extraordinary step of asking the Supreme Court for relief while the case was still playing out.
“Unfortunately, it appears the Government has treated this exceptional mechanism as a new normal. Historically, the Government has made this kind of request rarely; now it does so reflexively,” Justice Sotomayor wrote.
The Trump administration was not rewriting the rules of the American legal system as Justices Sotomayor and Ginsburg claimed.
Instead, they were merely asking the court to rein in rogue lower court judges attempting to exploit their position to decide questions of national public policy.
Unelected judges imposing their will over that of the people’s elected representatives is un-American.
By smacking down the Obama judge that imposed a nationwide injunction, the Supreme Court was sending a message.
They were tired of activists cherry-picking the jurisdictions in order to file lawsuits in front of ideological judges that result in predetermined outcomes and nationwide injunctions.
This “forum shopping” for nationwide injunctions is how multiple Trump immigration cases ended up before Judge Tigar.
Open borders activists knew they could count on Tigar to issue friendly rulings and block Trump initiatives.
Tigar’s politically motivated rulings and nationwide injunctions were an attack on American democracy.
And many Americans hope this Supreme Court ruling smacking him down will put an end to these acts of judicial tyranny.
The administration immediately filed an appeal with the Supreme Court to lift the injunction.
