Donald Trump may be the frontrunner for the White House.
But that doesn’t mean victory is assured.
And Megyn Kelly made one scary prediction about Donald Trump and 2024.
On the episode of her podcast following the fourth Republican debate Kelly spoke with National Review’s Rich Lowry and Jim Geraghty about the state of the race.
Kelly conceded that even though Trump didn’t show up for the debate, the night ended with Trump likely maintaining his 50-point lead in the polls over his GOP rivals.
“I don’t think anybody thinks anything really changed as a result of last night so once again, Trump won because if nothing changed, he’s the winner, he’s 50 points ahead,” Kelly began.
But Kelly warned there are troubled waters ahead for Trump.
Kelly cited a National Review column by former federal prosecutor Andrew McCarthy predicting that Obama Judge Tanya Chutkan would remand Trump to federal prison following a D.C. jury convicting him in the rigged 2020 election trial which would essentially end Trump’s presidential campaign.
Kelly predicted massive civil unrest with riots in the streets if the Democrats succeeded in weaponizing the justice system to take out the chief rival to Joe Biden to ensure victory in the 2024 election.
“So now what, guys? Andy McCarthy had an editorial on National Review saying he thinks Judge [Tanya] Chutkan might not let Trump go free on bond when he is likely convicted in that federal case in D.C.. There will be riots, the country will burn if she sends him to jail prior to November 2024, and Andy, he’s the smartest guy we all know, is saying ‘don’t rule it out.’ So where do we go from this day to that?” Kelly wondered.
In his column, McCarthy thoroughly debunked the charges Smith brought as not in line with the law and likely to be thrown out on appeal.
“I am doubtful about Smith’s charges of fraud, obstruction, and civil-rights offenses: (a) I don’t believe that the Supreme Court will sustain a ‘fraud on the government’ charge where the alleged fraud is not financial in nature (and as Dan McLaughlin has repeatedly pointed out — see, e.g., here and here — the Supreme Court in United States v. Gradwell (1917) held that corruption of the elections process is not cognizable fraud under the relevant statute); (b) there are significant questions about whether Trump’s conduct (mainly, relying on bogus legal theories) amounts to corrupt obstruction under the relevant statute (defining the parameters of that statute has deeply divided the D.C. Circuit); and (c) I don’t believe that Trump’s crusade to convince state and federal authorities to invalidate votes he claimed were improperly cast is properly addressed by a 19th century civil-rights statute that was intended to deal with preventing voters from casting ballots (mainly by intimidation),” McCarthy wrote.
But winning an appeal would take time and McCarthy believes Chutkan would throw Trump in jail while waiting out his appeal.
“If Trump is convicted and sentenced to prison, I would not bet on Chutkan’s granting him bail pending appeal. If she were to order him remanded, the former president would have to try to convince the D.C. Circuit to overrule Judge Chutkan and allow him to remain at liberty as the 2024 campaign ensued,” McCarthy added.
Chutkan jailing Trump before the election would push America into uncharted territory as it would validate the strategy of a sitting president enlisting partisan prosecutors and biased judges to knock an opponent polls show beating him out of the race.
