Democrats have been frustrated by the Supreme Court for years.
Now their frustrations are boiling over.
Joe Biden got hit with some bad news about a Supreme Court retirement.
Left-wing activists ramped up a pressure campaign on liberal Supreme Court Justice Stephen Breyer to step down.
Liberals understand that the Democrats’ 50 seat Senate majority could end at any moment and Republicans would then block any Breyer replacement until after the 2024 presidential election rolling the dice that the Republican nominee would defeat Joe Biden or Kamala Harris.
But the left’s lobbying for Justice Breyer to announce his resignation appears to be backfiring.
In a speech at Harvard Law School, Justice Breyer claimed that justices needed to show independence from the political party that nominated and confirmed them to the bench.
“My experience of more than 30 years as a judge has shown me that, once men and women take the judicial oath, they take the oath to heart,” Justice Breyer stated. “They are loyal to the rule of law, not to the political party that helped to secure their appointment.”
“If the public sees judges as politicians in robes,” Justice Breyer added, “its confidence in the courts, and in the rule of law itself, can only diminish, diminishing the court’s power.”
Justice Breyer was nominated by Bill Clinton and his refusal to step down in 2021 is seen by many as Breyer not wanting to let the left dictate his plans.
Breyer’s speech at Harvard suggests he is staying on the bench into 2022 in large part to present an image to the public of Breyer as a neutral judge and not a Democrat Party activist.
Critics contend that’s not true because in every important case Breyer—like all the liberal justices on the Supreme Court—vote in lockstep with the left’s preferred outcome.
In 2013, Democrats begged Ruth Bader Ginsburg to step down after Barack Obama won re-election and the party grew their Senate majority.
Ginsburg had already suffered a bout with cancer, but Ginsburg blew off these demands.
Some suspected that Ginsburg believed Hillary Clinton would win the 2016 election, and that Ginsburg wanted Hillary picking her replacement.
But Donald Trump won the 2016 election, and liberals began chewing their fingernails off worrying that Ginsburg’s health would take a turn for the worse allowing Trump to pick her successor.
The left’s worst fears came true when Ginsburg passed away in September and Donald Trump reshaped the Supreme Court into a six to three conservative majority by nominating Amy Coney Barrett to fill Ginsburg’s seat.
Democrats are terrified of Breyer staying on the bench, and Democrats losing their Senate majority before the 2022 election or an unforeseen reason which could lead to the seat remaining open until 2025.
