Clarence Thomas is now the most powerful justice on the Supreme Court.
That’s bad news for the left.
And Clarence Thomas set Democrats up for a big defeat with one brilliant move they never noticed.
After a madman committed an act of evil in Highland Park, Illinois, Democrats seized on the tragedy to push their anti-gun agenda.
Senate Majority Whip Illinois Democrat Dick Durbin falsely tried to claim a six-to-three majority opinion authored by Clarence Thomas expanding the scope of the Second Amendment and limiting the ability of Democrats to impose gun control led to the July 4 killings.
Durbin baselessly asserted Justice Thomas is “the same justice who wrote the opinion just a week or so ago that really basically said that there’s limitation on the regulation of these guns.
“So we can see that there [are] dots to be connected here, and they’re not very encouraging on a six-to-three [conservative majority] court,” Durbin continued.
Highland Park, Illinois has a so-called “assault weapons” and “high-capacity” magazine ban on the books.
Illinois law also calls for universal background checks and red flag laws.
In short, it is a gun-grabber’s dream.
But gun control does not work.
And Clarence Thomas set up the left seven years ago in a dissenting opinion to a Supreme Court opinion declining to hear a challenge to Highland Park’s so-called “assault weapons” ban.
Justice Thomas wrote that about five million Americans owned AR-15-style rifles easily letting them pass the Heller decision threshold of a commonly owned rifle and thus preventing the government from banning them.
“Roughly five million Americans own AR-style semiautomatic rifles,” Justice Thomas stated. “The overwhelming majority of citizens who own and use such rifles do so for lawful purposes, including self-defense and target shooting.”
In the case before the Seventh Circuit Court of Appeals the majority wrote that even though so-called “assault weapons” bans don’t stop mass shootings they are still acceptable.
“A ban on assault weapons and large‐capacity magazines might not prevent shootings in Highland Park (where they are already rare), but it may reduce the carnage if a mass shooting occurs,” the majority on the Seventh Circuit Court of Appeals wrote.
Justice Thomas responded at the time that the Supreme Court should take up the case “to prevent the Seventh Circuit from relegating the Second Amendment to a second-class right.”
Seven years later in his majority opinion in the Bruen case Thomas greatly restricted the right of the government to ban or regulate guns by saying any gun control law must line up with the “history and tradition” of Americans’ right to keep and bear arms.
