Now Democrats are completely focused on passing abortion legislation that kills tens of thousands of fully viable babies every year and consider anything less “oppressive.”
Nancy Pelosi has relied on the Supreme Court for years to do her job for her legislation.
Worse than that, many of the Democrat rulings have been used to erode states’ rights.
Where in the Constitution does it talk about abortion being a federally mandated law?
That’s right, it doesn’t.
For almost the first two hundred years of America’s history, states made their own laws when it came to abortion.
Roe v. Wade made the Constitution say something that it was never intended to say.
There’s a way to make the Constitution say something new, it’s called a constitutional amendment.
No matter which side of the abortion question, Roe v. Wade is insupportable legally.
That’s why Brett Kavanaugh used the case as an example when discussing “erroneous precedent.”
According to The Daily Wire:
Kavanaugh said that courts more often than not overturn precedents, such as when Planned Parenthood v. Casey overturned certain sections of Roe v. Wade.
“In Casey, the Court reaffirmed what it described as the ‘central holding’ of Roe v. Wade, the Court expressly rejected Roe’s trimester framework, and the Court expressly overruled two other important abortion precedents,” he wrote in the decision.
On the issue of stare decisis – the principle that forbids overturning precedent in fear that no precedent could prevail – Kavanaugh bluntly stated that while stare decisis should be respected, by no means should it become an “art of methodically ignoring what everyone knows to be true.”
“Stare decisis isn’t supposed to be the art of methodically ignoring what everyone knows to be true,” the justice wrote, as reported by Fox News. “Of course, the precedents of this Court warrant our deep respect as embodying the considered views of those who have come before. But stare decisis has never been treated as ‘an inexorable command.’”
“And the doctrine is ‘at its weakest when we interpret the Constitution’ because a mistaken judicial interpretation of that supreme law is often ‘practically impossible’ to correct through other means,” he continued. “To balance these considerations, when it revisits a precedent this Court has traditionally considered ‘the quality of the decision’s reasoning; its consistency with related decisions; legal developments since the decision; and reliance on the decision.’”
The Supreme Court has overturned 300 of its own decisions before now.
Nancy Pelosi tried to use an unverified claim of attempted rape, by a woman who had no connection to Brett Kavanaugh, to try and keep him off the Supreme Court.
As soon as the Supreme Court went conservative, the Democrats knew that the law they created through the court unfairly was now in danger.
Roe v. Wade is a textbook case of an unfair judicial ruling that should be overturned.
